Particular conditions of sale – Online shop

Article 1: Purpose

These General Terms and Conditions of Sale (GTCS) define the rights and obligations of the parties (the seller and the customer) in the context of the sale of goods by the Versailles Grand Parc Tourist Office and Convention Bureau, as seller, to the Customer, via its information and online sales website accessible at https://www.versailles-tourisme.com (hereinafter referred to as the “Website”).

 

Article 2: Definitions – General provisions

In these General Terms and Conditions of Sale and Use, the following words or expressions shall have the meanings set out below:

Seller and/or Tourist Office:

and which offers the goods described in these Conditions.

Goods: all items offered for sale on the Website.

Website: the Tourist Office’s website hosted at https://www.versailles-tourisme.com/ which allows users to purchase the goods described in these Conditions.

Customer and/or User: any person purchasing goods sold by the Tourist Office on its Website.

These General Terms and Conditions of Sale (GTCS) apply to all sales of goods carried out via the Tourist Office Website. The Seller reserves the right to amend these terms at any time by publishing a new version on its Website. The GTCS applicable are those in force on the date on which payment is made (or first payment in the case of multiple payments).

The Customer declares that they have read all of these General Terms and Conditions of Sale and accept them without restriction or reservation. The Customer acknowledges that they have received the advice and information necessary to ensure that the offer meets their needs. They declare that they have the legal capacity to contract under French law or validly represent the natural or legal person on whose behalf they are acting. Unless proven otherwise, the information recorded by the Tourist Office constitutes proof of all transactions.

These General Terms and Conditions of Sale (hereinafter the “GTCS”) apply to orders placed and paid online on the Website by the User (hereinafter the “goods”). Reservations and/or orders for which the Website redirects the User to partner service providers of the Tourist Office are excluded from the scope of these GTCS; these services are exclusively supplied and managed by, and under the responsibility of, the said third-party provider, pursuant to the contractual terms applicable to that third party provider.
 

Article 3: Customer information

Customers acknowledge that they have received all essential information regarding the goods before concluding the contract.

Customers receive by email an order confirmation, including a telephone number or contact details allowing them to reach the Tourist Office or suppliers:

Right of withdrawal: pursuant to Article L. 221-18 of the French Consumer Code, the customer has a period of 14 days from collection to change their mind. If the customer exercises this right, the seller must issue a refund.

 

Article 4: Goods

4.1 Characteristics

Each item offered for sale on the Website is described on a dedicated product page specifying its essential characteristics within the meaning of Article L. 111-1 of the French Consumer Code.

4.2 Compliance

The goods comply with the applicable regulations relating to the safety and health of persons, fair commercial practices, and consumer protection at the time they are placed on the market.
They comply with French law in force at the time they are placed on the market.

Article 5: Prices, fees and charges

Prices for goods are indicated in euros, all taxes included, clearly shown on the product description pages and on the product order page, excluding specific shipping fees.

The total amount payable by the Customer is indicated on the order confirmation page. The sale price of the product is that in force on the day the order is placed. In the case of a promotional offer, the Tourist Office undertakes to apply the promotional price to any order placed during the period of validity of the promotion.

The Tourist Office reserves the right to modify its prices at any time, while guaranteeing the Customer the application of the price in force on the date of the order.

 

Article 6: Conclusion of the online contract

The Customer must follow a specific series of steps to place an order on the Website, namely:

Step 1: selection by the User of the desired goods after reading the essential characteristics shown on the Website. At this stage, the Customer selects the goods.

Step 2: confirmation by the User of the information shown in the basket summary, recalling the selected goods, the total price of the goods and the amount payable to the Tourist Office, as well as the information entered by the User, who may identify and correct any errors at this stage according to the methods indicated on the Website, modify their order, or cancel it entirely.

Step 3: completion of required fields on the Website form (otherwise the order cannot be processed by the Tourist Office) and acceptance of the GTCS.

The Tourist Office will send the Customer an order confirmation email including the invoice.

In order to properly process the order, and pursuant to Article 1316-1 of the French Civil Code, the Customer agrees to provide truthful identification information. The Tourist Office reserves the right to refuse an order, for example in the event of an abnormal request, bad faith, or any legitimate reason.

 

Article 7: Provision of the service by the Tourist Office

The essential characteristics of the goods and their respective prices are made available to the Customer on the Tourist Office Website. The Customer confirms that they have received full details of the payment terms, collection conditions, and contract performance. The Tourist Office undertakes to fulfill the order within the limit of available products only. Otherwise, the Tourist Office will inform the Customer. These contractual details are presented clearly and in French. In accordance with French law, they are summarised and confirmed when the order is validated.

In accordance with the legal provisions on conformity and hidden defects, the Tourist Office will refund or exchange defective products or products that do not match the order.

 

Article 8: Liability of the Tourist Office

Within the limits of applicable law, if the Tourist Office is held liable by a competent court toward a Customer, liability shall not exceed the amount actually paid by the Customer for the goods ordered.

The Tourist Office cannot be held liable, in particular, in the following cases:

8.1 Website content

Unless the Tourist Office has been duly informed of the existence of illegal content under applicable law and has not acted promptly to remove it, the Tourist Office cannot be held liable for the Content or actions or lack of action by Customers, nor for the services requested by them.

8.2 Access difficulties

The Tourist Office does not guarantee continuous and secure access to its Services, as Website functionality may be affected by many factors beyond its control. Consequently, within the limits of applicable law, the Tourist Office excludes all warranties, conditions or other provisions and cannot be held liable for financial or reputational loss, nor for indirect, incidental, or consequential damages arising from or related to the use of its Website or Services.
 

Article 9: Payment

Payment is due immediately upon ordering. The Customer may pay by bank card. Cards issued by banks located outside France must be international cards (Mastercard or Visa). Secure online payment by bank card is carried out by our payment provider. The transmitted information is encrypted according to best practices and cannot be read during transmission over the network.

Pursuant to the French Monetary and Financial Code, card payment is irrevocable. By submitting banking information during the sale, the Customer authorizes the seller to debit their card for the amount indicated. The Customer confirms that they are the legal holder of the card and legally entitled to use it. In the event of error or inability to debit the card, the sale is automatically cancelled and the order void.
 

Article 10: Cancellation and refund

Cancellations by the Tourist Office will result in a full refund of the transaction to the Customer. In the event of cancellation by the Customer under the right of withdrawal, the Customer will receive a full refund upon return of the goods either at the boutique or by postal return.
 

Article 11: Intellectual property rights

Trademarks, domain names, products, software, images, videos, texts, and more generally all information subject to intellectual property rights remain the exclusive property of the Tourist Office. No transfer of intellectual property rights is made under these GTCS. Any reproduction, total or partial, modification, or use of these items for any reason whatsoever is strictly prohibited.
 

Article 12: Exceptional and unavoidable circumstances

The performance of the obligations of the Tourist Office under this agreement is suspended in the event of exceptional and unavoidable circumstances preventing performance. The Tourist Office shall notify the Customer of the occurrence of such an event as soon as possible.
 

Article 13: Invalidity and contract amendment

If any provision of this contract is invalidated, such invalidity shall not result in the invalidity of the remaining provisions, which shall remain in force. Any contractual amendment is valid only after written agreement signed by both parties.
 

Article 14: Personal data protection

14.1

In accordance with French Law No. 78-17 of 6 January 1978 relating to data processing, files, and freedoms, the website www.versailles-tourisme.com has been declared to the CNIL under number 1991543 v 0.

14.2

Personal information provided by the Customer, including the number, name, and address associated with the credit card, on the Website enables processing and execution of orders, and is encrypted to prevent it from being read when transmitted via the Internet using “Paybox” encryption. Security is guaranteed by PCI-DSS certification of the Paybox payment platform, compliant with current security standards issued by professional bodies such as GIE Carte Bancaires, Visa, Mastercard, etc.

14.3

Information essential to processing and executing orders is indicated with an asterisk on the Website pages. Other optional information or information relating to the User’s interests and offers that may be sent is used to improve knowledge and enhance the services offered. Information provided by the Customer when making a reservation will not be transmitted to any third party other than the supplier of the reserved services. This information will be treated as confidential. It will be used solely by internal services of the Versailles Grand Parc Tourist Office and Convention Bureau and by service providers for processing reservations and to enhance and personalise communication and offers intended for Customers.

14.4

In accordance with the French Data Protection Act, the Customer has the right to access, modify, rectify and delete their data. This right may be exercised by contacting:

14.5 Cookie policy

To continuously improve our online communication tools and provide a better user experience, we measure key indicators such as number of visits, page views, and user activity on the Website. We collect this information using Google Analytics. This technology uses cookies.

Article 15: Pre-contractual information – Acceptance by the Member

The Customer acknowledges that they have received, prior to placing their order and concluding the contract, in a readable and comprehensible manner, these General Terms and Conditions of Sale and all the information listed in Article L. 221-5 of the French Consumer Code, including:

– essential characteristics of the goods;
– price of goods and related charges;
– information regarding legal and contractual guarantees and implementation procedures;
– information regarding the right of withdrawal (existence, conditions, period, exercise procedures, and standard withdrawal form), termination options, and other important contractual conditions;
– accepted payment methods.

By placing an order on the Tourist Office Website, any natural or legal person fully accepts these General Terms and Conditions of Sale and undertakes to pay for the ordered Services. The Customer expressly acknowledges this and waives reliance on any contradictory document, which shall be unenforceable against the Tourist Office.
 

Article 16: Governing law

All clauses in these General Terms and Conditions of Sale, as well as all purchase and sale operations herein, are subject to French law. Any dispute not resolved amicably shall fall exclusively under the jurisdiction of the Tribunal de Grande Instance of Versailles for legal entities, and for individuals, jurisdiction is assigned to the competent court in accordance with Article L. 141-5 of the French Consumer Code.
